Plaintiffs in Dicamba Case Appeal EPA Guidance in Relation to Ninth Circuit Ruling

The ongoing debate over the registration of dicamba took another turn as plaintiffs in the Ninth Circuit Court trial filed an emergency motion seeking to have the court order a stop use of dicamba following the EPA's actions to vacate the registration while allowing for the continued use of existing stocks already sold prior to the court's ruling through July 31st. The plaintiffs, who include the Center for Food Safety and the Center for Biological Diversity, claim that the EPA ignored the court's order by allowing continued use of dicamba. The EPA said it stood behind its order and that it was prepared to provide a strong defense at the appropriate time. Bayer, a defendant-intervenor in the original lawsuit, vowed to fight the emergency motion in court.
