Negotiations in Senate Aim to Address Farm Workforce Issues and Migrant Labor

Negotiations in the U.S. Senate on the Farm Workforce Modernization Act continue, but a bipartisan consensus remains difficult to reach and time is running short as Congress approaches the August recess and an upcoming election season that will usher in a new Congress in January. Primary among the sticking points revolve around worker protection measures that would open employers to potential liability risks among other challenges. The House approved the measure in March 2021 with a bipartisan vote of 247-174.

The Farm Workforce Modernization Act would expand the H-2A visa program, allow for some year-round work, and provide a new path to legal status for existing workers.
