Arkansas Supreme Court Rules Against Monsanto on Plant Board Regulation

On Thursday, May 6th, the Arkansas Supreme Court ruled against Monsanto in regards to its claims related to Plant Board Regulation 7, which relates to additional research that may be necessary for registration of pesticides in Arkansas and additional restrictions the state may place on registered products. The Court determined that the Regulation 7 did not violate the Commerce Clause of the United States Constitution and that it is not invalid as being enacted by an unconstitutionally appointed board. However, the court did side with Monsanto on its cross appeal in relation to the constitutionality of the statute governing appointment of members of the Plant Board.
