9th Circuit Denies Petition to Halt Use of Existing Dicamba Stocks

The Ninth Circuit Court of Appeals denied a petition from plaintiffs for an emergency motion to override the Environmental Protection Agency (EPA) order that suspended the registration of three dicamba products while permitting the use of existing stocks for in-crop use through July 31st. The Ninth Circuit previously ruled in favor of the plaintiffs in ordering the EPA to vacate the registration of the three dicamba formulations (Xtendimax, Fexapan and Engenia). The court case continues with the companies representing the products seeking a separate ruling from the court that would recall the previous ruling of the court and order a stay on the initial registration for the products.
