Ninth Circuit Denies BASF Effort to Reverse Order to Vacate Dicamba Registration

Another dicamba related decision in the ongoing Ninth Circuit Court of Appeals came on Thursday, June 25th, when a panel of judges denied a motion by BASF to stay and recall the court's June 3rd order to the EPA to vacate its registrations for Xendimax, Fexapan, and Engenia. The EPA's June 8th order implementing the Court's initial order remains in effect. The EPA order allows for continued use of stocks sold by June 3rd up to July 31st provided they're used in accordance to federal labels and state regulations currently in place. The EPA has not indicated its plans for considering a new registration for these herbicides for 2021 and beyond.
