EPA Moves Forward with Chlorpyrifos Ban

On February 25, the U.S. Environmental Protection Agency (EPA) announced that it was denying the objections, requests for hearing, and stay requests filed on the final rule revoking all “tolerances” for chlorpyrifos, which establish an amount of a pesticide that is allowed on food. The result is an effective ban on use of the pesticide in agriculture. A pending lawsuit currently in the Eighth Circuit Court of Appeals challenges the EPA and seeks to allow limited use of the product. Plaintiffs in the suit, which are comprised of agricultural organizations, are seeking an action by the court to place a stay on the pending chlorpyrifos ban and dismiss it.
