On Wednesday, the Ninth Circuit U.S. Court of Appeals denied a petition to vacate the registration of Corteva Agriscience's Enlist Duo herbicide, a 2,4-D-choline and glyphosate premix designed for use over 2,4-D-tolerant Enlist crops. The challenge against the registration was brought by environmental groups who brought similar actions against registrations of dicamba herbicides for Bayer's dicamba tolerant seeds. The 2-1 decision determined that the EPA indeed followed appropriate procedures in registering Enlist and that the registration should stand. However, the court did rule that the EPA should make adjustments to the registration as it relates to risk to monarch butterflies.
